NO PURCHASE NECESSARY. VOID WHERE PROHIBITED OR RESTRICTED. ALL PRIZES WILL BE AWARDED. All federal, state, and local laws and regulations apply. Open and offered only to legal residents of the continental United States and the District of Columbia, age 21 or older at time of entry.
This Sweepstakes (“Sweepstakes”) begins at 7:00 a.m. CDT on February 27, 2008, and ends at 11:59:59 p.m. CDT on April 30, 2008. Electronic entries must be received by 11:59:59 p.m. CDT on April 30, 2008, and mailed entries must be postmarked by April 30, 2008 and received no later than May 6, 2008.
HOW TO ENTER: To enter electronically, access our website at www.relishmag.com and follow the instructions. To enter by mail, legibly print your first and last names, complete address, city, state, zip code, e-mail address (optional), daytime telephone number, and the name of the Sweepstakes on a postcard or a 3” x 5” piece of paper and send to: Sunny-Side Up Sweepstakes, Relish Magazine, 341 Cool Springs Blvd., Suite 400, Franklin, TN 37067. Entries submitted via email or facsimile are prohibited. The odds of winning any prize will be the same by alternate means of entry as by online entry.
One entry per household or email address. In the case of multiple entries, only the first entry will be accepted. In the event of a dispute over the identity of an online entrant, entry will be deemed submitted by the holder of the email account. Publishing Group of America, Inc. (“PGA”) is not responsible for technical failures in entry transmission, or lost, late, misdirected, damaged, incomplete, illegible or postage due mail. By participating in this Sweepstakes, each entrant accepts the conditions stated in these Official Rules, agrees to be bound by the decisions of PGA, and warrants that she/he is eligible to participate in this Sweepstakes.
PRIZES: One Grand Prize winner and one (1) guest will receive round-trip airfare from the winner’s closest airport to Guerneville, California (via San Francisco Airport, Oakland Airport, etc.), a two-night stay at Applewood Inn and Spa (the “Inn”), two (2) breakfasts and one (1) dinner. Approximate retail value of Grand Prize is $2,500. The value of the prize set forth above represents PGA’s good-faith determination of the retail value thereof. Prize is not transferable or redeemable for cash. PGA reserves the right to substitute a prize with one of equal or greater value in the event prize is unavailable. Odds of winning depend on the total number of eligible entries received. Winner is responsible for all expenses and taxes not included in the prize package, including without limitation, meals, tips, incidental expenses, travel to and from the airport, insurance, room service, souvenirs, incidentals and other personal expenses. Restrictions may apply. All prizes will be fulfilled by PGA no later than June 30, 2009. Reservations are the responsibility of the winner. Trip must be taken by June 30, 2009 or trip will be forfeited in its entirety, and no substitution or cash equivalent will be offered.
ELIGIBILITY: All entries become property of PGA. Employees and directors of Applewood Inn and Spa (the “Inn”), and PGA, and their immediate family members and residents of their household, and the Inn, PGA and vendors, affiliates, or subsidiaries are ineligible to participate. Winner's travel companion must be age 21 or older and complete a liability release prior to any travel.
WINNERS: All winners will be notified by mail. The Grand Prize winner and guest, where permitted, will be required to complete and return an Affidavit of Eligibility/Release of Liability, which must be signed and received by PGA or its designated agent within fourteen (14) days of date of notification, or an alternate winner will be selected in a random drawing. If any prize notification letter is returned as undeliverable, the prize will be awarded to an alternate winner in a random drawing from all non-winning entries.
Winner will be randomly selected from all eligible entries received by PGA. Drawing conducted on or about May 14, 2008, by a representative of PGA, whose decisions are final and binding on all matters relating to this Sweepstakes. Acceptance of prize constitutes permission (except where prohibited) to use winner’s name, hometown, and likeness for purposes of advertising and publicity without additional compensation. PGA reserves the right to cancel the Sweepstakes if it becomes technically corrupted.
DISQUALIFICATION: The use of robotic, automatic, macro, programmed or like methods (including without limitation the use of any promotion/sweepstakes subscription, notification, entry or like sites or service that offers sweepstakes entry services “on behalf of” entrant) is strictly prohibited.
GENERAL: By entering, entrants acknowledge that neither PGA nor the Inn have made nor are in any manner responsible or liable for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relating to the prizes. By participating, winner (and the winner's traveling companion) releases PGA, the Inn, their respective officers, directors, employees, affiliates, subsidiaries, advertising, promotion, fulfillment, marketing agencies, public relation firms, consultants or contractors from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses to persons (including death) and property that may be sustained in connection with the receipt, ownership, possession, acceptance, enjoyment, use or misuse of a prize, or arising out of participation in this game, or while preparing for, participating in, and/or traveling to any prize-related activity. IN NO EVENT WILL PGA, THE INN, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, SUBSIDIARIES, ADVERTISING, FULFILLMENT, MARKETING AGENCIES, PUBLIC RELATIONS FIRMS, CONSULTANTS OR CONTRACTORS BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, ARISING OUT OF ANY ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZES AWARDED IN CONNECTION WITH THE SWEEPSTAKES, INCLUDING WITHOUT LIMITATION, ANY CLAIMS BASED ON PUBLICITY RIGHTS OR INVASION OF PRIVACY.
The state and federal courts located in Nashville, Tennessee shall have exclusive jurisdiction of any controversies regarding this Sweepstakes, and the laws of the State of Tennessee shall govern the Sweepstakes. Each entrant waives any and all objections to jurisdiction and venue in these courts and hereby submits to the jurisdiction of those courts. Any and all lawsuits or other disputes that arise relating to this Sweepstakes must be filed within one (1) year from the date that the winners are drawn. The failure of PGA to exercise or enforce any right or provision of these Official Rules shall not constitute a waiver of such right or provision. If any part of these Official Rules is held by a court of competent jurisdiction to be invalid or unenforceable, that part will be enforced to the maximum extent permitted by law, and the remainder of these Official Rules will remain fully in force.
